There was an article on ADN about this a few days ago and it's so stupid I don't even want to post it- but it brings up a valid question. What type of cannabis within your car should consider you for a DUI? Obviously, smoking and driving under the influence of the 'drug' is against the law- and constitutes a DUI. But, many people are now saying that a half-smoked joint is the same thing as an opened bottle of alcohol. If it's in your vehicle you should automatically be considered for a DUI. What do you think?
Here's my opinion, and I'm probably playing devil's advocate here- but I'm against intoxicated driving of any kind. Honestly, there are people out there on prescription pain pills who shouldn't be driving. I know that cannabis definitely has an effect on my concentration and I have no doubt that if I drove while high I could cause an accident. I know different people have different reactions to smoking, and because of this it's a gray area. Tolerance is different with everyone as well- so one person could smoke a little and be fine while another would smoke the same amount and be 100% stoned.
At the end of the day- you shouldn't have a half-smoked joint in your vehicle. There are better places to smoke it, and to keep it. A full joint, rolled, but not lit? Sure! Drive with it! It's the same as an unopened bottle of alcohol. But once that joint has been lit either finish it or keep it out of your car.

Why should pot smokers be subject to "special" rules?
Having a half smoked "J" found in a car doesnt constitute a automatic guilty of a DUI, IMHO....... When you see a female dressed all trashy, does that automaticly condem her to being a street walker? Isnt hooking against the law? When a man dresses like a "Pimp", does that say he his into sex trafficing, once again, against the law. Can you see where im going with this? A half smoked "J" sitting in a car could have alot of diffrent meanings out there, and until they can keep the public safe from drunk drivers, and not keep putting bandaids on a flesh wound, im not going to give two shites about seeing a half smoked "J" in a car!
Now, if you will excuess me, I need to go out and get my half smoked joint out of the car, that I "Didnt finish" before a hike.

If you have an opened container of alcohol in your car- you're subject to a DUI. Why shouldn't a used cannabis product exhibit the same 'under the influence' assumption? I'm not saying having cannabis in your car- period, is a bad thing. It's not. You could have a freaking lunch sack of green in your car, but if you don't have a tool to consume it with (unless you're literally eating it- and let's be honest, no one does that), then no one has the right to assume you're under the influence. But, once you put that weed into a pipe, bowl, bong, or yes- joint, then I think it's entirely fair for a law officer to assume you were consuming that substance in your car, and you are at the risk for being under the influence. And cops do assume specific things. If a woman is dressed scantily clad and standing on a street corner I can guarantee the policeman will have reasonable rights to approach her, question her, and assume she's doing something illegal. I do agree that we need higher efforts in keeping drunk drivers off of the road- but as a girl who knows I occasionally get too stoned to drive safely, I think we should put the same efforts into keeping people under the influence of marijuana off of the roads as well.

I see your point as well Gypsy, yet we both know it's not going to be a half joint. Why is a half joint any different then ajoint that's been hit once, or the rez in a pipe? When is one hit to many for the road, or is there a set limit like with booze before you drive? I don't condone smoking and driving, without question, but I done condone being jacked by the cops for a burnt joint. I can remember how many times I've went to the cabin and grabbed a couple of already open bottles of whiskey and threw them in the truck, and been pulled over twice and the cops seeing the bottles. Nothing happened, no dui test, no big hassle, just a missing plate on the front of the truck. So why should someone be automatically guilty?? Honestly, I'm not to worried about it, when's the last time you read some story about some stoner going mad behind the wheel and mowing people down?........it's the drunks that worry me! I did read a short article in Maxim Magazine a few years ago, where a company came up with a DUI road test for weed. A sweat strip under your arm for 1 min, and test results in 2 mins, and accuracy within 10min of smoking, so "It" is on its way, if you know what I mean....

Well, I think if the Breathalyzer catches it then it’s a problem. I don’t have an experience with such a thing. Also, I am looking for a good Los Angeles DUI lawyer as my uncle has been charged for DUI and want to save him as he is the sole earner in the family.
